Bicycle Use and Rental Regulations
I. PURPOSE AND SCOPE OF THE REGULATIONS
The purpose of these Regulations is to establish the conditions for the use of 50 bicycles and their related equipment, purchased within the framework of the “Interreg RO-HU 00467 TREEATHLON” project, owned by the Municipality of Biharia (hereinafter referred to as the “Lender”) and stored in the locality of Biharia.
These Regulations apply to the Lender, as well as to organized groups legally using the bicycles, their representatives, and the actual users (hereinafter collectively referred to as the “Borrower”).
II. RENTAL CONDITIONS AND APPLICATION PROCEDURE
The 50 bicycles owned by the Lender (30 children’s bicycles and 20 adult bicycles) may be used free of charge in accordance with the conditions set out in these Regulations.
The bicycles may be made available exclusively to organized groups consisting of residents of Biharia and Covaci, primarily students of local educational institutions and the teachers/adults accompanying them.
The rental process shall take place following prior scheduling and on the basis of a written application submitted to the Municipality of Biharia. The application must specify the exact period of use. Available time slots can be monitored through the active platform of the project at www.treeathlon.ro.
III. RIGHTS AND OBLIGATIONS OF THE BORROWER
The Borrower is obliged to use the bicycles in accordance with their intended purpose and in compliance with all applicable road traffic regulations.
The Borrower is obliged to protect the bicycles against theft, damage, destruction, and any other form of loss or deterioration.
The Borrower may not perform any structural modifications, unauthorized repairs, or alterations to the bicycles. In the event of a technical malfunction, the Borrower must immediately notify the Lender.
Upon the expiration of the period specified in the application, the Borrower is obliged to return the bicycles in full, clean, and in a condition suitable for normal use, placing them in the designated storage area located in the courtyard of the Municipality.
IV. LIABILITY AND COMPENSATION
The Borrower assumes full financial and legal responsibility for any personal injuries occurring during the rental period, as well as for any damage caused to the bicycles. The Borrower is responsible for ensuring adequate health, property, and liability insurance for themselves and the members of their group.
If the bicycles are damaged, destroyed, or lost during use, the Borrower shall compensate the Lender for the full value of the damage incurred (repair costs or replacement value).
Any person or group responsible for causing damage shall, in addition to fulfilling their compensation obligations, be excluded from borrowing the bicycles again for a period of six (6) months from the date of the incident.
